Employers must appoint one or more competent persons to help them comply with statutory health and safety obligations.

A named competent person does not have to be an employee, but whether you appoint internally or externally the person assigned the role must have sufficient levels of experience and knowledge.

They have to demonstrate awareness and understanding of the relevant legislation, potential hazards, and how to manage health and safety effectively for the specific business environment.

They need to be on top of any changes in legislation and provide practical advice on keeping your business legally compliant.

Not having a named competent person who is sufficiently experienced and knowledgeable is a breach of your legal duties in itself, even if no incident has taken place (Regulation 7, The Management of Health and Safety at Work Regulations 1999).

If there is a safety incident and you don’t have a named person or you’ve named someone inappropriate or ill equipped for the role, the consequences can be very serious indeed.

These can range from enforcement notices, to hefty fines, reputational damage or even prosecution in the most serious cases.
